Right to Information Act, 2005 Disposal of Request

Here are some notes on the disposal of requests under the Right to Information Act, 2005 (RTI Act) in detail:

  • Section 7(9) of the RTI Act sets out the following ways in which a request for information can be disposed of by the PIO:
    • By providing the information to the requester.
    • By refusing to provide the information, stating the reasons for the refusal.
    • By providing the information in part, stating the reasons for not providing the information in full.
    • By referring the request to another public authority, if the information is not held by the PIO.

Here are some of the important things to keep in mind when the PIO disposes of your request for information:

  • If the PIO refuses to provide the information, they must state the reasons for the refusal.
  • If the PIO provides the information in part, they must state the reasons for not providing the information in full.
  • If the PIO refers the request to another public authority, they must inform the requester of the decision and the name and contact details of the other public authority.

If you are not satisfied with the way in which your request for information has been disposed of by the PIO, you can appeal to the Information Commission. The Information Commission is a statutory body that is responsible for resolving disputes under the RTI Act.
